COMPETITION TERMS

1.1. The promoter is DTR Holdings Pty Ltd. ABN 41 011 063 264, of 4496 Goodwood Road, Bundaberg, QLD, Australia, 4670 (“the Promoter”).

1.2. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

1.3. Entry to the competition is free.

2.1. Entry is open to residents of Australia.

2.2 Entrants under the age of 18 years must obtain the prior permission of a parent or guardian over the age of 18 years before entering the competition.

2.3. Entrants in the competition may enter once only.

2.4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

3.1. The promotion commences at 10:00 AM (AEST) on 16/09/24 and ends at 11:59 PM (AEST) on 29/09/24 (“Promotion Period”).

4.1. To enter, individuals must complete the following steps during the Promotion Period:

a) Follow @avo.fresh on Instagram
b) Visit https://avofresh.com.au/competitions and complete the entry form, including your name, email postcode, and any other required details. By completing the entry form, you will also be signed up for the AvoFresh Club and will receive emails from us. You will have the option to opt out of the AvoFresh Club and unsubscribe from emails at any time.

5.1. The draw will take place on 30/09/24. One prize winner will be drawn at random and will be announced online within five (5) business days of the draw.

5.2. The total prize pool is valued at $149. The prize details are as follows:

a) Eighteen (18) AvoFresh Guacamole 160g Tubs.
b) A voucher to the value of $50.

5.3. The winning prize will be shipped to the winner at no cost. However, due to the chilled nature of the product, delivery will depend on the winner’s location. If the product cannot be shipped to the winner’s location, the Promoter reserves the right to substitute the prize with vouchers of equivalent value, which can be used exclusively for the purchase of the winning product.

5.4. Prizes are not redeemable for cash and will be forfeited if the winner is unable to confirm their shipping address and claim the prize within seven (7) working days of notification. If for any reason the winner does not take the prize or any element of the prize at the time stipulated by the Promoter, then the prize or any element of the prize will not be redeemable for cash.

5.5. In the event that a prize is forfeited after seven (7) days, the Promotor reserves the right to substitute the winner via a second draw. The Promoter will endeavour to contact the original winner of the prize before completing a redraw.

5.6. The first and last names of the prize winner will be published online via https://avofresh.com.au/competitions for a minimum period of thirty (30) days.

6.1. Each entrant who has entered the competition over the Competition Period and registered all details in accordance with clause 4 will be entered into the prize draw.

6.2. The winner will be notified by email and announced on the AvoFresh website and on the original Instagram competition post within five (5) business days of the draw.

6.3. The Promoter’s decision is final and no correspondence will be entered into.

7.1. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process.

7.2. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

7.3. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:

a) to disqualify any entrant; or

b) to modify, suspend, terminate, or cancel the promotion, as appropriate.

8.1. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees, and agents) excludes all liability for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special, or consequential, arising in any way out of the promotion.

8.2. The Promoter is not responsible for any technical malfunctions or for any lost, late, incomplete, incorrectly submitted, delayed, or misdirected entries, claims, or correspondence, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure, or otherwise.

8.3. The Promoter will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

9.1. The Promoter collects personal information (“PI”) to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, and prize suppliers.

9.2. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://avofresh.com.au/privacy-policy/.

9.3. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research, and profiling purposes, including sending electronic messages or telephoning the entrant.

10.1. By participating, entrants acknowledge that this promotion is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram or TikTok.

10.2. Entrants fully release Facebook, Instagram and TikTok from any liability in connection with this promotion.

11.1. These Terms and Conditions are governed by the laws of Australia. Entrants submit to the non-exclusive jurisdiction of the courts of Australia.
